How do I hire without creating problems later?

Contracts, offer letters and probation terms that protect the business from day one, not just paperwork to get someone started.

No setup fee. One month's notice to cancel. See membership pricing.

The legal position

What the law expects from the paperwork

Most labour disputes are decided on documents that were signed, or never signed, long before anything went wrong. These are the rules that shape them.

Written particulars from the first day

The BCEA requires every employee to receive written particulars of employment when they start: who the employer is, the job, where it is done, hours, pay, leave, notice and the other terms the Act lists. When the terms change, the written particulars must be updated to match.

BCEA s29

Probation is a period of assessment, not a lesser job

The Code of Good Practice: Dismissal, in force since 4 September 2025, treats probation as a reasonable period to assess whether a new employee meets the standard. The employee must be told the standard, given feedback and support, and heard before probation ends in dismissal.

Fixed-term contracts and contractors are scrutinised

For employees earning below the BCEA earnings threshold, a fixed-term contract running longer than three months needs a justifiable reason, or the employee is treated as permanent. The same employees are presumed to be employees, not contractors, where the hallmarks of employment are present.

LRA s198B and s200A

A rule only counts if it was known

You can only discipline fairly for breaking a rule the employee knew, or could reasonably be expected to know, and that is applied consistently. Clear, communicated policies are what make later discipline defensible.

Common mistakes

Where employers get caught out

Almost all of these come down to a decision made without checking first. That is the part we fix.

FAQ

Questions employers ask us

Do I really need a written contract for every employee?

The BCEA requires written particulars of employment for every employee covered by it, from the day they start. A properly drafted contract is the simplest way to meet that requirement and to record the terms you will rely on if something goes wrong later.

Can I just use a contract I found online?

You can, but generic contracts are often written for another jurisdiction or leave out terms the BCEA requires. Every document in the ClearLine library is built for South African labour law and filled in with your own details.

Are the documents Word files I can edit?

Library documents and custom drafting are delivered as finished PDF documents. If a term needs to change, update it in the portal and generate the document again, or ask for a custom document.
